“PALOMA BELIEVERS’ MAP” TERMS & CONDITIONS

1. What is the Promotion. The company under the name “THREE CENTS HELLAS SINGLE-MEMBER S.A.”, having its registered office in Athens (2 Ploutarchou St.), VAT No. EL801429363 – Athens Tax Office for Commercial Companies, General Commercial Registry (GEMI) No 156630501000, legally represented by Mr Ioannis Athanasiadis (hereinafter the “Promoter” or “THREE CENTS”) is holding a promotional activity – competition (hereinafter the “Competition” or the “Promotion”) related to the Promoter’s brand, “Three Cents”. To conduct this Promotion, the Promoter has partnered with “FIFTY FOUR S.A.”, a company with registered office in Gerakas, Attica (10 Imathias St.) (hereinafter the “Partner“).

 

2. This Promotion is not sponsored, supported or conducted by, nor associated with Instagram in any way.

 

3. This Promotion is open to employees of food establishments – partners of Three Cents based in Greece, Cyprus, Switzerland, Croatia, Ireland, Poland, Czech Republic, Italy, Denmark, Norway, Sweden, United Kingdom, France, Netherlands, Bulgaria and Romania who have an active Instagram account (hereinafter referred to as “User(s)“). The food establishment must send an inbox message to the Instagram account of Three Cents (@threecents_official) confirming that the User actually works in that food establishment and that it allows the establishment’s name to be mentioned in the User’s post. Participation in the Competition is exclusively and only subject to the Terms and Conditions listed herein. Participation in this Competition implies the express acceptance of the following Terms and Conditions.

4. Duration of the Promotion. The Promotion will start on 22/05/2024 at 11:00am (hereinafter the “Promotion Start“) and it will end on 21/06/2024 at 12:00pm (hereinafter the “Promotion End“). Any entries received past this period of time shall be considered void and will not be taken into account in the determination of the winners. It is expressly clarified that, after the end or the shortening of the deadline or the cancellation of the Competition under these terms and conditions, any entries received shall be automatically considered invalid and non-existent, they shall have no effect whatsoever, they shall not grant any right to participate in the Competition, they shall not be binding for any party, they shall cease to be valid and shall not confer any rights whatsoever in relation to the Competition’s Prizes.

 

5. How to enter the Promotion. To enter the Promotion, each User must follow the procedure described on the Promoter’s website. To enter the Competition, entrants should (a) visit https://threecents.com/paloma-map-contest and check out the terms of the Competition; (b) upload  a photo of a Paloma cocktail on their Instagram account, using the hashtags #10yearsTruePaloma and #ThreeCentsPaloma; (c) mention and tag the Instagram account of Three Cents (@threecents_official) and the food establishment’s Instagram account so that the Promoter can include their details (food establishment name and address) in the Paloma Believers’ Map, which can be viewed at https://threecents.com/world-paloma-map; and (d) send a message to the Promoter’s Instagram account (@threecents_official) stating:  “I hereby accept the terms and conditions of entry in the competition and consent to the processing of my personal data by the Promoter and FIFTY FOUR for the purpose of entering the Competition and the prize draw and of being contacted (if I am deemed the winner) for the delivery of the prize”. Fulfilment of the above conditions entitles the Entrant to participate in the Promotion.  Please note that for the entry to be considered valid, the Entrant’s Instagram account must be set to “public”.

 

No purchase of any of the products that may be marketed by the Promoter is necessary to enter the Competition. By completing the procedure above, entry in the Competition is considered complete. Entrants are solely responsible for the entries they submit in the Promotion. The records that shall be kept by the Promoter and/or the Partner, on the instruction of and on behalf of the Promoter, containing the details of the Users and their legal representatives, shall constitute full proof that an entry was received as part of the Promotion, including that such entry was eligible.

 

Entrants may only enter the Promotion once. The Promoter and/or Partner may cancel, at their absolute discretion, any entry that they consider to be the result of the use of illegal technical devices or fraud, or the wrongful interference of the Entrant or a third party. All Entrants must abide by the laws, fair trading practices and Instagram’s terms of use. In particular, any content that is inappropriate (such as obscene, offensive, defamatory or violating personal data, intellectual property rights, third party rights, etc.) is strictly prohibited. It is at the Promoter’s discretion to reject content that it deems to be inappropriate. Entrants who display such content shall be held responsible for any loss or damage caused to the Promoter. In order to enter the Competition, Entrants must use their own means to have access to the internet. The Promoter shall not be liable if for any technical reason it is not possible to receive and register an Entrant’s participation in the Account system.

 

 

6. Selection of the Winners.

One (1) winner and four (4) runners-up will be selected during the first draw and ten (10) winners and ten (10) runners-up will be selected during the second prize draw of the Competition. Both draws will be conducted electronically. Both prize draws will take place on 25-06-2024.

Immediately after the prize draws and the determination of the winners, the Promoter or the Partner will send a private message (inbox message) to the winners’ Instagram profiles asking for their details – name, phone number and email. Subsequently, within five (5) calendar days from the date when the above message was sent, the winners must provide the requested information by private message (inbox message) in order for the Promoter to contact them.

In the event that any of the winners does not respond to the communication or declares that they do not wish to receive their Prize within a period of five (5) working days from being informed that they won, the Promoter shall be released from any obligation towards the specific winner and the Prize shall pass on to the first runner-up, following the same procedure as above, and so on. The Promoter bears no responsibility if all attempts to contact the winner/runner-up fail (for reasons such as failing to receive their Prize, etc.) and the Promoter reserves the right to award the Prize to the runners-up, or to withdraw it.

The Promoter may at its discretion change the day and/or time of the prize draw for technical or other reasons, by posting a notice on threecents.com. The total number of entries will be submitted in this prize draw to determine the winners.  After the prize draw, entries will be checked in terms of eligibility. In the event that all or part of the winners selected are deemed invalid, the same check shall be carried out on the runners-up. Each Winner is entitled to only one (1) Prize, even if they have more than one active Instagram accounts (and therefore multiple usernames) and have been selected as a winner under different usernames. In this case, they shall receive only the prize that they are entitled to from the first prize draw. The Promoter reserves the right to request from each winner, before receiving the prize, to sign a declaration of acceptance of the Competition T&Cs and a declaration of acceptance of the prize.

7. Prizes.

The winner of the first draw will receive: one (1) holiday package to Mexico consisting of: economy flights for one person to and from a Mexican city chosen by the Promoter (place of departure to be determined by the Promoter and subject to availability), during the period from 27/10/24 (Sunday) to 03/11/24 (Sunday) and six (6) nights accommodation in a single room at a 3-star hotel in the country of Mexico of the Promoter’s choice. Any other travel, food and accommodation expenses in Mexico shall be assumed by the winner.

The winners of the second draw will receive: one (1) bag with one (1) T-shirt, one (1) single leaf sticker and one (1) beach towel.

The Prizes may not be redeemed for cash, exchanged, transferred to another person or sold, nor is it possible to use them at any other time, except as defined above.

 

The Promoter and the Partner bear no criminal or civil liability towards any winner or third party for any accident and/or damage and/or for any physical or other harm that they may suffer, directly or indirectly, in relation to the Prize, the use of the Prize or for any other reason. The above companies bear no responsibility for any defects in the Prize or otherwise and they do not have nor undertake any obligation towards the Entrants and/or the winner beyond delivering the Prizes to the winners, who shall accept the Prize in accordance with these terms and conditions.  Once the Promotion has expired and the Prize has been distributed as described above, any obligations of the Promoter and the Partner cease to exist. The Promoter and the Partner shall not have nor assume any obligations towards the Entrants.

 

8. Personal Data.

For this Promotion, the Promoter (“Controller“) shall keep a record of the Entrants’ personal data (public profiles of the Users on the social media platform), as indicated above, which shall be processed exclusively for the purpose of carrying out the Competition. Such personal data shall be stored and processed using automated and/or non-automated methods, in order to enable the completion of the Promotion.

 

In particular, to administer the Promotion, the contact details provided by the Entrants when entering the Competition are collected and stored, in order to confirm the eligibility of their entry in the Competition and to be able to contact them in the event that they win, so as to receive the prize. The Promoter transmits the data above to the Partner (“Processor“) who shall process the data at the behest of, and according to, the instructions of the Promoter. Subsequently, and in order to send the Prize to the winners/runners-up, the following personal data of the winners/runners-up shall also be requested: name, email, phone number and postal address.

 

The Promoter shall take all necessary measures to ensure that personal data is collected and processed legitimately and lawfully, and kept secure in accordance with the provisions of the General Data Protection Regulation 2016/679 (GDPR), Law 4624/2019 and the particular regulatory framework for its implementation, keeping any information that comes to its knowledge secret and confidential.

The legal basis for the processing of the above data is the Promoter’s obligation to fulfill the obligations arising from the terms and conditions of the Promotion. The Promoter shall not transmit the data above outside the EEA, however, it may be done so by Instagram as part of storing the data on the Promotion’s platform. In connection with personal data storage, Instagram uses the storage mechanisms mentioned in its data policy, which was accepted by the Entrants when they activated their Instagram accounts.

 

In addition to the company that hosts the Instagram platform, only duly authorized employees or external partners of the Promoter (the advertising agency, etc.), who act on the Promoter’s account and undertake on its behalf to hold and administer the Promotion, shall have access to the Entrants’ and the Winners’ data.

 

The Promoter shall retain the Entrants’ data for the duration of the Promotion and for two (2) months after its completion; after this two-month period, the Entrants’ data shall be destroyed and Entrants will lose all rights to request their recovery.

 

Entrants have the right to:

1. request access to their personal data;
2. request that their personal data be rectified, insofar as they are inaccurate or incomplete;
3. request that their personal data be erased, provided that the conditions set by the national and European legislative framework for the exercise of such rights are met;
4. request that the processing of their personal data is restricted only for specific purposes;
5. object to the processing of their personal data;
6. request portability of the data that they have provided, i.e. to receive the data that they have provided in a structured, commonly used machine-readable format or to request that they be sent to a third party designated thereby. In addition, the Entrants shall retain all rights related to automated decision-making.

 

The Entrants have the right to submit their complaints regarding the processing of their personal data to the Hellenic Data Protection Authority (www.dpa.gr).

 

If the Entrants have any enquiries regarding their personal data or if they wish to exercise any of their aforementioned rights, they may contact the Promoter by email at info@threecents.com.

 

To enter the Promotion, Entrants must provide the aforementioned personal data and allow processing thereof; such obligation is incumbent on the Promoter (Controller’s) obligation to fulfill the terms of the Promotion. The Promoter may fulfil their obligation to distribute the prizes to the winners only insofar as they provide their additional contact data. Therefore, if the Entrants do not wish to have their personal data processed as described above, they cannot enter the Competition, and if the Winners do not wish to provide the additional contact data, they will not be able to receive their prize.

9. Notice of Competition Cancellation – Amendment of Terms & Conditions. The Promoter has the right to cancel the Competition or to amend these terms and conditions, including the duration of the Promotion and the dates of the prize draws, by posting a notice on its website, the effective date of such cancellation/amendment being the date when the notice was posted.

 

10. Acceptance of Terms & Conditions. These terms and conditions of entry can be found at https://threecents.com/paloma-map-contest. Any Entrant or third party may receive a duplicate copy of these Terms and Conditions at their own expense.

By accepting the terms and conditions, each Entrant declares that they are over 18 years old, they have read the conditions of entry and are aware thereof, they fully accept them and agree to the processing of their personal data in accordance with aforementioned conditions, and they accept that Instagram bears no liability in connection to the Promotion. Entering the Competition requires the unconditional acceptance of all the terms and conditions set forth herein and entails the subsequent waiver of any entitlement or claim against the Promoter. Entrants do not have nor acquire any rights whatsoever over the trademarks, names, signs, indications, emblems and other insignia of the Promoter and/or the Partner. These terms and conditions are governed by the laws of Greece.

 

Any dispute that may arise in relation to the Promotion shall be subject to the exclusive jurisdiction of the courts of Athens.

 

 

APPENDIX

 

Declaration of Acceptance of Winner’s Prize

 

Applies to the Winner of the “PALOMA BELIEVERS’ MAP“ Competition.

 

1. PRIZE ACCEPTANCE TERMS

I, the undersigned, ………………….., declare that I hereby accept the Prize that I won from THREE CENTS. Once I receive the Prize as set out below, THREE CENTS and FIFTY FOUR will have no further obligation to me. The Prize includes:

 

One (1) holiday package to Mexico consisting of: economy flights for one person to and from a Mexican city chosen by the Promoter (place of departure to be determined by the Promoter and subject to availability), during the period from 27/10/24 (Sunday) to 03/11/24 (Sunday) and six (6) nights accommodation in a single room at a 3-star hotel in the country of Mexico of the Promoter’s choice. The travel agencies AKTINA S.A., Worldwide Travel Bureau and Rentavan SA de CV is responsible for the prize fulfilment and the provision of the services involved in the holiday package.

 

The Prize is strictly personal and cannot be transferred, redeemed or exchanged for cash or for any other prize. Once the Prize dates are confirmed, they cannot be amended.

 

On my own responsibility I declare that:

1. I have read and I expressly and unconditionally accept all the terms and conditions of the Competition;
2. I am 18+ years of age;
3. I unreservedly take delivery of the Prize;
4. I am travelling on my own responsibility and I have taken all recommended precautionary measures to protect my health [e.g. inoculation(s), medication]. THREE CENTS, FIFTY FOUR, AKTINA S.A., Worldwide Travel Bureau and Rentavan SA de CV will not be held liable for any delays to itineraries, accidents, illness or mistakes committed by the persons in charge of the provision of the services of any kind at any part of the holiday package. In addition, THREE CENTS will not be held liable in any way, under the criminal or civil law, to any prize recipient or third party, for any accident and/or damage and/or injury and/or physical or material damage incurred, that is directly or indirectly related to the Prize, the journey and the winner’s stay in Mexico, or from any other cause.
5. Proper travel documents (identity card, passport, visa) in the name of the winner are a prerequisite to travelling. Therefore, THREE CENTS, FIFTY FOUR, AKTINA S.A., Worldwide Travel Bureau and Rentavan SA de CV will not be held liable if I am unable to obtain the relevant documents for any reason, the legal propriety of which is a condition of the prize fulfilment. I am solely responsible for exercising the care and assuming the cost necessary for obtaining the above travel documents.
6. THREE CENTS reserves the right to amend any journey detail, whether it is material or not. Any amendments will be notified as soon as this is reasonably possible.
7. I assume full responsibility and incur the cost for meals, admissions to venues and ground transportation* during my stay in Mexico from 27/10/24 to 03/11//24 (*in addition to travel, meals and admissions included in the Prize). The holiday package does not include costs of personal nature including food, beverages or any other personal expenses, such as accommodation expenses, souvenirs from shops, museums or hotels, telephone calls, laundry expenses, room service, vehicle rental, any excursions, etc., for which I will be solely responsible.
8. During my stay in Mexico I shall comply with the instructions and suggestions provided by the persons responsible and the representatives of THREE CENTS.
9. I consent to any use of my name and photo, including the use of any audiovisual material produced for promoting the Competition held by THREE CENTS, in any printed or website media or in any broadcast media (such as TV, radio) without any fee or compensation.

3. After the expiry of the Competition, my personal data will be destroyed beyond recovery (except for the audiovisual material produced as described above, the rights of which have been assigned in perpetuity to THREE CENTS), unless I have given my express consent below (a) to be updated on any future promotions by THREE CENTS and/or new products and services and/or (b) to set up a personal profile for the purpose of being provided customized and personalized information/targeted advertising.

I acknowledge that I am aware of my rights, i.e. that throughout the duration of the processing I can (a) submit an electronic request to info@threecents.com regarding (i) the right of access to my personal data, (ii) the right to rectification of my personal data, (iii) the right to erasure, (iv) the right to restriction, opposition/objection to the processing of my personal data, (v) the right to portability, (vi) withdrawal of my consent for the processing of my personal data and (b) lodge a complaint before the Data Protection Authority.

 

Finally, I hereby confirm that I have been fully informed on such processing, as described above, regarding the categories of my personal data which will be recorded and broadcasted, the purpose of such collection and broadcasting of the said audiovisual medium, the recipients of this material, which are the aforementioned parties, but also regarding the details of the person responsible for the processing of such material and my personal data, which is THREE CENTS, as well as the processors of my personal data, which are the companies FIFTY FOUR, AKTINA S.A.
